
In violation of federal law, the USOPC is now requiring USA Climbing to ban trans women from competitions. If USAC refuses to comply they face decertification as an olympic governing body, threatening their organization.
The USOPCs compliance with Executive Order 14201 and their requirement of national governing bodies to comply violates Chapter 2205, Subchapter II, Section 220522, part 15 of the Ted Stevens Act which states that:
“An amateur sports organization, a high-performance management organization, or a paralympic sports organization is eligible to be certified, or to continue to be certified, as a national governing body only if it … does not have eligibility criteria related to amateur status or to participation in the Olympic Games, the Paralympic Games, the Pan-American Games, or the Parapan American Games that are more restrictive than those of the appropriate international sports federation.”

Because the International Federation of Sport Climbing currently allows trans women to compete, USA Climbing is being forced to choose between being decertified by the USOPC if they don't comply, or being in violation of the Ted Stevens Act (and therefore also risking decertification) if they do comply. The USOPC has been told by the Trump Administration that the Justice Department will not enforce this clause, however this does not change the fact that they are still in violation of this federal law. The Trump Administration has created a policy that violates federal law and is choosing to not enforce this law as a means of excluding trans women in sports.
